The Original Jurisdiction of the U.S. Supreme Court While the vast majority of cases considered by the U.S. Supreme Court come to it in the form of an appeal to a decision by one of the lower federal or state appeals courts, a few but important categories of cases can be taken directly to the Supreme Court under its â€Å"original jurisdiction.† Original jurisdiction is the power of a court to hear and decide a case before it has been heard and decided by any lower court. In other words, it is a court’s power to hear and decide a case before any appellate review. The Fastest Track to the Supreme Court As originally defined in Article III, Section 2 of the U.S. Constitution, and now codified in federal law at 28 U.S.C.  § 1251. Section 1251(a), the Supreme Court has original jurisdiction over four categories of cases, meaning parties involved in these types of cases can take them directly to the Supreme Court, thus bypassing the usually lengthy appeals court process. In the Judiciary Act of 1789, Congress made the Supreme Courts original jurisdiction exclusive in suits between two or more states, between a state and a foreign government, and in suits against ambassadors and other public ministers. Today, it is assumed that the Supreme Courts jurisdiction over other types of suits involving the states was to be concurrent or shared, with the state courts. The categories of cases falling under the Supreme Court’s original jurisdiction are: Controversies between two or more states;All actions or proceedings to which ambassadors, other public ministers, consuls, or vice consuls of foreign states are parties;All controversies between the United States and a state; andAll actions or proceedings by a state against the citizens of another state or against aliens. In cases involving controversies between states, federal law gives the Supreme Court both original- and â€Å"exclusive†- jurisdiction, meaning such cases may be heard only by the Supreme Court.   In its 1794 decision in the case of Chisholm v. Georgia, the Supreme Court stirred controversy when it ruled that Article III granted it original jurisdiction over suits against a state by a citizen of another state. Both Congress and the states immediately saw this as a threat to the sovereignty of the states and reacted by adopting the Eleventh Amendment, which states: â€Å"The Judicial power of the United States shall not be construed to extend to any suit in law or equity, commenced or prosecuted against one of the United States by Citizens of another State, or by Citizens or Subjects of any Foreign State.†Ã‚   Marbury v. Madison: An Early Test An important aspect of the Supreme Court’s original jurisdiction is that its Congress cannot expand its scope. This was established in the bizarre â€Å"Midnight Judges† incident, which led to the Court’s ruling in the landmark 1803 case of Marbury v. Madison. In February 1801, newly elected President, Thomas Jefferson - an Anti-Federalist - ordered his acting Secretary of State James Madison not to deliver commissions for appointments for 16 new federal judges who had been made by his Federalist Party predecessor, President John Adams. Katzenbach, for example, South Carolina challenged the constitutionality of the federal Voting Rights Act of 1965 by suing U.S. Attorney General Nicholas Katzenbach, a citizen of another state at the time. In its majority opinion written by revered Chief Justice Earl Warren, the Supreme Court rejected South Carolina’s challenge finding that the Voting Rights Act was a valid exercise of Congress power under the enforcement clause of the Fifteenth Amendment to the Constitution. Original Jurisdiction Cases and Special Masters’ The Supreme Court deals differently with cases considered under its original jurisdiction than those reaching it through its more traditional â€Å"appellate jurisdiction.† In original jurisdiction cases dealing with disputed interpretations of the law or the U.S. Constitution, the Court itself will usually hear traditional oral arguments by attorneys on the case. However, in cases dealing with disputed physical facts or actions, as often happens because they have not been heard by a trial court, the Supreme Court usually appoints a â€Å"special master† to the case. The special master- usually an attorney retained by the Court- conducts what amounts to a trial by gathering evidence, taking sworn testimony and making a ruling. The special master then submits a Special Master Report to the Supreme Court. The Supreme Court then considers the special master’s ruling in the same manner as a regular federal appeals court would, rather than conducting its own trial. Next, the Supreme Court decides whether to accept the special master’s report or to hear arguments over the disagreements with the special master’s report. Finally, the Supreme Court decides the case by voting in its traditional manner, along with written statements of concurrence and dissent. Original Jurisdiction Cases Can Take Years to Decide While most cases that reach the Supreme Court on appeal from lower courts are heard and ruled on within a year after being accepted, original jurisdiction cases assigned to a special master can take months, even years to settle. The special master must basically â€Å"start from scratch† in handling the case. Volumes of pre-existing briefs and legal pleadings by both parties must be read and considered by the master. The master may also need to hold hearings in which arguments by the lawyers, evidence, and witness testimony may be presented. This process results in thousands of pages of records and transcripts that must be compiled, prepared and weighed by the special master. For example, the original jurisdiction case of Kansas v. Nebraska and Colorado involving disputed rights to water from the Republican River was accepted by the Supreme Court in 1999. Four reports from two different special masters later, the Supreme Court finally ruled on the case 16 years later in 2015. As the rules change on Animal Farm Squealer is sent to the other animals to justify the changes or reminds them that those rules were always there. Squealer is thought of as a politician trying to convince another party that there parties ideals are right although on Animal Farm the other animals aren’t smart enough to debate the witty arguments Squealer presents. Limiting the terms of debate and creating a â€Å"right or wrong† argument creates greater control over the animals and less rebuttal. Squealers complicated language makes the Animals uneasy and they agree in doubt. Squealers name also suits him as to squeal depicts his vocal manor in his job for Napoleon. Old Major's power didn't live long enough for his power to corrupt him, however he did use his power to get rid of those whose power had corrupted them – Mr. Jones. For a short period after his death – until Napoleon, the next power head, steps up – his power is still ensured which leads the rebellion and the first strands of life on the newly named Animal Farm.Not long after the death of Old Major, Napoleon steps up as the unofficial leader because at that stage It Is thought to have equality with all animals. The idea that ‘all animals are equal but some are more equal than others', Isn't about Just yet. Napoleon was always a respected person. He has a â€Å"reputation for getting his own way', which provided him with a small level of power. There Is a saying that reads, ‘knowledge Is power and power Is knowledge'. Napoleon lets his power corrupt him and doesn't see m to notice or care about the consequences of his actions which is an attribute of a terrible leader and person that holds power. Napoleon was a harsh, unjust and corrupt holder of power.But not all people who old power are corrupt or are even that obvious that they hold power. An example of this is Boxer. He holds a level of power not to the extent of Napoleon or even Old Major however it is still there. Power isn't Just about having control over people it is, power can also be having an influence on a group of people – or in this case animals – or having people look up to you as an inspiration. Boxer has this type of power. He has a big influence on the other animals especially the smaller ones that feel they are looked down upon.Where Napoleon sends other animals to kill a fellow, Boxer is overwhelmed with distress at the prospect of killing someone even if that someone is a human. â€Å"Nothing could have been achieved without Boxer. † Boxer isn't one of tho se people who crave power, in fact shied away from it at most. He sat quietly and did his work no matter the conditions or complications he worked until he literally couldn't stand anymore. Boxer is one to prove that not everyone in power will become corrupt. It Just depends on your morals and what type of person you are and the things you believe in. Not everyone in power will inevitably become corrupt.

Danish is More than a Pastry Okay...this is one of the saddest things. I just spent 45 minutes typing this email and then the stupid mail system broke down and it was lost when I sent it! Aaaghh...the horror... The email was about my crazy, crazy day yesterday. What an adventure! But what happened, exactly? Well, I'll start from the very beginning! Here goes: I woke up to a beautiful day. Took my time preparing breakfast and enjoyed my good cup (well, cups) of coffee, as well as a bowl of oatmeal with sugar and raisins sprinkled on top, soaked 3/4s with milk. Delicious! I checked my email and started psyching myself up for the bike ride into Copenhagen. When 10:30 rolled around, I got my stuff together and headed out. I began my long, arduous journey from Roskilde to Copenhagen officially at 10:45. Rested from last night's good sleep, I could push myself and make it there in about an hour and a half. I was in no hurry though...my first obligation for the afternoon was meeting Carolina concerning our IPO (initial public offering) project due next week. And my first class wasn't until 3:30. So I had plenty of time! I was spinning pretty well...staying in second gear mostly. Yeah, that is NOT a typo...second gear. It must be noted that this bike HAS only 3 gears. It's my host-mom's bike...3 gears, purple frame, and you pedal backwards to brake. Oh, and when it's dark out I use what you call a "dynamo". I push it down until it touches the front wheel's rim, start pedaling, and it creates electricity so the light turns on! So smart! (I just consulted with my host-brother, Michael, and have decided to name my bike "Lille Lilla" which is "Little Purple" in Danish. That's a nice name) Right, back to the story...so Lilla and I are heading steadily east and I'm thinking "Gosh! This is amazing! I'm in Denmark...biking.....into school!" How cool is that? I'm in Europe and it's gorgeous here!" Sometimes I just get this overwhelming happy feeling; it's almost unreal I'm here. I'm about halfway to Copenhagen and I cross an intersection. Red light runners cause hundreds of deaths and tens of thousands of injuries each year. In 2009, 676 people were killed and an estimated 130,000 were injured in crashes that involved red light running. About half of the deaths in red light running crashes are pedestrians, bicyclists, and occupants in other vehicles who are hit by the red light runners. An Institute study of urban crashes found that those involving drivers who ran red lights, stop signs and other traffic controls were the most common type of crash (22 percent). Injuries occurred in 39 percent of the crashes in which motorists ran traffic controls. Enforcement is the key to getting people to comply with a law, but communities don't have the resources to allow police to patrol intersections as often as would be needed to ticket all motorists who run red lights. Studies have shown that the presence of cameras reduces red light running. If a vehicle enters an intersection any time after the signal light has turned red, the driver has committed a violation. Motorists inadvertently in an intersection when the signal changes are not red light runners. In locations where a right turn on red is permitted, drivers who fail to come to a complete stop before turning may be considered red light runners. However, communities differ as to whether they issue tickets for it when it is caught on camera. A study conducted during several months at 5 busy intersections in Philadelphia, Pennsylvania, prior to the use of red light cameras found that, on average, a motorist ran a red light every 20 minutes at each intersection. During peak travel times, red light running was more frequent. Daniel X: Demons and Druids Over two hundred thirty million copies of the Daniel X series have been sold worldwide. The author James Patterson wrote Daniel X: Demons and Druids in collaboration with Adam Sadler. The publishing date is July 2010. In the book, Daniel X is an alien hunter who is looking for number three on his alien list of outlaws, Phosphorius Beta. â€Å"Think of a million or so angry wolves-on fire, that’s a pretty good approximation of number three†, well that’s how Patterson puts it. The epic battle between alien hunter and fire has begun.I enjoyed Daniel X because of the author’s action and how he weaves myths and fiction into the story, but I disliked Patterson’s writing style and several other points of the book. James Patterson’s novels are known for full on action, and adrenalin. An example of action and adrenalin is when Daniel X is caught by alien number forty-three on the alien list of outlaws; he turns back time an d explodes number forty-three with a bomb. This is pure action because Daniel puts his life on the line to fulfill his mission to kill aliens.Another example of action and adrenalin is when Daniel X and his friends are get caught by vampirus sapiens. In the example of action and adrenalin, the action takes place when he transforms, but the adrenalin kicks in when the vampirus sapien loosened his grip on Daniel X’s hands. James Patterson excels at making abnormal events seem normal or regular. I liked how James Patterson placed Merlin the sorcerer and Arthur Pendragon in the story, and how he made Stonehenge, merely a monument a big part in his story. It is ironic that Patterson weaved Stonehenge, merlin, and druids together.When I think of druids I think of aliens or demons. Stories, Myths, and books say that druids built Stonehenge, but there isn’t any evidence that proves that they did. Druids are actually high priests of the Celts. The only reason why people believe that they built it is because they were alive during that time. Yet legend has it that merlin built Stonehenge. Merlin brought the stones to Salisbury Plain from Ireland. Sometime later there was a massacre of three hundred noble men and a memorial was needed. Merlin then moved Stonehenge to Britain to bury them.However in the book Merlin and his mentor help a group of people build Stonehenge. Even though James Patterson is a genius when it comes to Science fiction he still needs to work on writing his books. Even through James Patterson is a great author, I don’t always enjoy his books. Two things I didn’t like about the book, was that Patterson didn’t introduce well in the beginning and that he made the chapters too small. I expected him to explain Daniel X‘s history in the prologue so that the readers could understand things about his background and understand what he’s been through.Since, Patterson made the chapters in his book so small it real ly takes time to make or figure out what’s going to happen. If Patterson had made the chapters longer he would have had wasted less time trying to make a point, but the only difference would be that the book would be smaller. Patterson introduces Daniel X’s history in chapter nine; all the chapters in the book are small and even the epilogue has a small chapter. I loved the book because of all the action and adrenalin that James Patterson put in it, and the abnormal or irregular events that occurs , but I disliked the introduction and Patterson’s idea of short chapters.I enjoyed Daniel X because of the author’s action and how he weaves myths and fiction into the story, but I disliked Patterson’s writing style and several other points of the book. I’d recommend this book to preteens, I would give this book a three out of five, but if you are not satisfied, there are several other series that James Patterson has made. For example Maximum Ride, Witch and Wizard, Alex Cross and the Women’s murder club, and the rest of the Daniel X series.
